SMS Privacy Policy & Terms and Conditions

Northwest Academy is committed to protecting the privacy and security of our students, parents, guardians, and staff. This Privacy Policy explains how we collect, use, and share personal information in connection with our text messaging (SMS) communication system (the "Service"). This Service is used to convey important, time-sensitive information related to educational purposes.

Your participation in our SMS Service is voluntary. By opting in to receive text messages from us, you agree to the terms of this Privacy Policy.

1. Information We Collect
When you opt-in to receive SMS messages from us, we collect the following information:

  • Phone Number: The mobile number provided during the opt-in process.
  • Identification and Relationship Information: We associate your phone number with your name and/or the name of your student(s) to ensure messages are relevant. This may include your status as a parent, legal guardian, or staff member. This information is typically sourced from the MySchool App.
  • Message Content and Metadata: We may keep a record of the messages we send and any messages you send to us (e.g., "YES" to confirm, or "STOP" to opt out). We also collect standard metadata, such as message delivery status, timestamps, and associated carrier information.

2. How We Use Your Information
We use the personal information collected strictly for educational and school-related operational purposes, including but not limited to:
  • Emergency Notifications: Alerts regarding school closures, lockdowns, evacuations, weather-related delays, or other urgent safety matters.
  • Attendance Information: Notifications regarding student absences or tardiness.
  • General School Announcements: Reminders about parent-teacher conferences, school events, testing schedules, and important deadlines.
  • Academic Updates: Optional alerts regarding grades, assignments, or other academic-related information.
  • Service Administration: Managing opt-in and opt-out requests and ensuring the proper functioning of the SMS Service.
Your personal information will never be used for commercial marketing, third-party advertising, political campaigning, or for creating profiles for non-educational purposes.

3. Consent
Your SMS opt-in applies to communications from Northwest Academy only. Your consent to receive SMS messages is specific to our school and does not extend to third-party businesses or affiliates unless explicitly stated and separately agreed upon.

4. Compliance with Federal and Oregon Law
Our policies and practices are designed to comply with applicable privacy laws, including:
  • Telephone Consumer Protection Act (TCPA): We obtain your express consent before sending you informational text messages. You can revoke this consent at any time. To opt out of all text messages from Northwest Academy, reply STOP to any message you receive. You may also receive a one-time confirmation message of your opt-out. For help, reply HELP. Message and data rates may apply.
  • Children's Online Privacy Protection Act (COPPA): Our SMS Service is intended for communication with parents, legal guardians, and staff members who are over the age of 18, and students who are 13 or older and have provided appropriate consent. For students under 13, consent is obtained from a parent or legal guardian.

5. Opt-Out Instructions
You can opt out of our SMS service at any time by unchecking the Text box in your MySchool App messaging preferences. For help, you can contact us directly at nwa@nwacademy.org.

6. Who We Share Your Personal Information With
We do not sell or rent your personal information. We only share personal information in the following limited circumstances:

  • Third-Party Service Provider: We utilize a third-party platform to transmit SMS messages. We share your mobile phone number and the message content with this provider solely for the purpose of delivering the communication. Our contract with this provider requires them to maintain the confidentiality and security of your information and prohibits them from using it for any other purpose.
  • School Personnel: Information may be accessible to authorized school administrators, teachers, and staff who have a "legitimate educational interest" as defined by the Family Educational Rights and Privacy Act (FERPA) to perform their official duties.
  • Legal Obligation: We may disclose personal information if required to do so by law, subpoena, or in response to a valid legal process from a court or government agency.

7. Security of Your Information
We take reasonable measures to protect the information you provide from unauthorized access, disclosure, or misuse. However, no system is completely secure, and we cannot guarantee the absolute security of your data during transmission or storage.

8. Record-Keeping and Proof of Consent
As required by the TCPA and Campaign Registry guidelines, we maintain records of all opt-ins and opt-outs, including timestamps and the method of consent. These records are kept securely and may be used to demonstrate compliance with regulatory requirements if needed.

9. Changes to This Policy
We reserve the right to update or modify this Privacy Policy at any time. Any significant changes will be communicated via SMS or on our website.
